WEBSITE PHOTO SUBMISSION GUIDELINES
This request for submissions is administered by the Cambridge Office for Tourism located at 4 Brattle Street, Suite 208, Cambridge, MA 02138. Requests for photo submissions for use on the Website will be ongoing commencing March 12, 2013.
The submission request is open to all individuals aged 18 or over who have access to an Internet connection via a mobile device and who download the Instagram mobile application.
No purchase required. Submissions must be submitted via the Instagram mobile application, which can be downloaded from www.instagram.com, the Apple App Store (iOS) or Google Play (Android). Submissions by mail or any other channel will not be accepted. No communication or correspondence related to submissions will be exchanged with submitters, except in selected cases.
Submitters are invited to take photographs of any thing or place within Cambridge city limits and to post these photographs to Instagram using the hashtag #picturecambridge.
Submitters may post as many pictures as they like each day, more than one picture may be chosen to be featured on the official Cambridge Office for Tourism Website. As a Submitter of any image, you agree 1) that the image belongs to you, and 2) that you have consent of anyone clearly depicted in the image.
All individuals who post a photograph in accordance with these terms and conditions are considered to be submitters. To submit photos, submitters must:
- Log in to the Instagram application.
- Take a photograph.
- Add the #picturecambridge hashtag in the Instagram photo caption.
- Post the photograph to the Instagram network.
4. SELECTION PROCEDURES
Members of the Cambridge Office for Tourism staff will select images that will be featured on the Website. Submitters will be notified via comment on the photo in Instagram within 30 days if their submissions are selected.
5. INTELLECTUAL PROPERTY
Submitters authorize the Cambridge Office for Tourism to use all photographs tagged with the #picturecambridge hashtag solely for the purpose of promoting the destination of Cambridge, MA through the CambridgeUSA website, as well as through promotional materials and advertisments by the Cambridge Office for Tourism. The photos are not to be resold or reused for profit in any way. Any usage other than as outlined in these Rules would be negotiated by the original photographer. Usage rights and copyrights of any material submitted to the Cambridge Office for Tourism, in whole or in part, will be the property of the original photographer.
6. GENERAL TERMS AND CONDITIONS
Failure to comply with any of the aforementioned terms and conditions or any other terms and conditions indicated in these Submitter Rules will lead to automatic elimination of the image from consideration for selection. Selected Submitters who have not met these requirements will not be eligible to have their submissions considered for selection. Submissions will be subject to a check by the Cambridge Office for Tourism. All submissions or attempted submissions that are fraudulent, incomplete, submitted or received late or otherwise non-compliant may be rejected, in which case the submission and selection may be withdrawn, depending on the circumstances. Any decision made by the Cambridge Office for Tourism regarding any aspect of these submissions, including but not limited to eligibility and disqualification of submissions, will be final and without appeal.
The Cambridge Office for Tourism reserves the right to disqualify an individual or withdraw one or more submissions made by an individual who submits or attempts to submit an image in a manner that contradicts the terms and conditions of these Rules or that is unfair toward other Submitters (e.g., computer hacking, use of a program, device or software program that may interfere with the procedures, conduct or technical aspects of submission). Any such individual may be referred to the appropriate legal authorities. The decisions of the Cambridge Office for Tourism in this regard will be final and without appeal.
In the event that a prize might be offered at any time for submissions, and, for reasons unrelated to the winners, the Cambridge Office for Tourism is not able to award a prize at any time for submissions, they reserve the right to replace the prize with one of the same kind and equivalent value or, at their discretion, remit the cash value of the prize as indicated in these Rules. Winners release the Cambridge Office for Tourism, its affiliates and the advertising and promotional agencies related to any future contests, as well as their employees, agents and representatives, from any liability for damages that they may incur as a result of accepting or using their prizes. To be declared a winner and prior to accepting a prize, the selected Submitters must sign a declaration form to this effect.
The Cambridge Office for Tourism and their advertising and promotional agencies, as well as their employees, agents and representatives, disclaim all liability for the malfunction of any computer component, software, application or communication line, for the loss or lack of a communications network or for any transmission that is faulty, incomplete, incomprehensible or erased by any computer or network and that may limit or eliminate an individual’s ability to enter a submission. The Cambridge Office for Tourism also disclaims all liability for any malfunction of the Internet network that prevents access to the contest page or the Instagram application or interferes with the conduct of the submission. Moreover, the Cambridge Office for Tourism cannot be held liable for any fees incurred related to the use of Internet data. Although the Cambridge Office for Tourism will do everything they can to provide Submitters with information and tools that are accessible and accurate, they cannot be held liable for errors (specifically those related to postings on the submission sites or the transmission of erroneous information to Submitters), the unavailability of information or the presence of viruses on the Instagram application. By entering a submission, submitters acknowledge and accept the characteristics and limitations of the Internet, the lack of protection against possible misuse or hacking of data and the risk of contamination by viruses that may be circulating on the network. It is incumbent upon Submitters to take all the necessary steps to safeguard their own data and software on their computer and telephone systems against any such risks.
The Cambridge Office for Tourism and their advertising and promotional agencies, as well as their employees, agents and representatives, cannot be bound to any other terms than those stipulated herein. The Cambridge Office for Tourism reserves the right to, at their sole discretion, cancel, change or suspend any terms outlined herein, in whole or in part, or to terminate it, in the event of an incident or human interference that alters the administration, security, impartiality or conduct of the submission or usage as described in these Rules, if applicable. In the event the Submission Rules are modified, suspended or terminated, Submitters will be notified by way of the same channels as those used to promote the Submissions.
In the event that the computer system cannot save all the submissions for whatever reason, or in the event the submission period must be terminated in whole or in part before the closing date indicated in these Rules, submissions may be selected as specified in Section 4, at the discretion of the Cambridge Office for Tourism.
By entering or attempting to enter submissions, submitters release the Cambridge Office for Tourism, their subsidiaries and their advertising and promotional agencies, as well as their employees, agents and representatives, from any liability for damages that Submitters may incur as a result of taking part in or attempting to take part in submission of images for usage on the Website.
Should any paragraph of these Rules be declared or ruled illegal, unenforceable or invalid by a court of competent jurisdiction, this paragraph will be considered null and void. However, the other paragraphs that are not affected will continue to be valid, within the legal constraints of the law.
Submission of images is subject to all applicable federal, provincial and local laws and regulations.
